Firm Highlights Springer-Sullivan & Roberts LLP celebrates its victory in Nolan v. Heald College, 551 F.3d 1148, 2009 WL 69238 (9th Cir. Jan. 13, 2009), where the Ninth Circuit decided the important issue that plaintiffs in ERISA cases are entitled to have courts apply traditional rules of summary judgment to them and to receive bench trials with live testimony where there is evidence of the plan administrator’s conflict of interest that appears outside of the claims record. This decision will have a positive impact on all plaintiffs seeking to have their benefits restored under an ERISA plan where the plan administrator both pays the benefits and makes the claims decision. SSR served as co-counsel with Geoffrey V. White in this case. |
